Commentary
"Democracy" is one of Leonard's most ambitious songs, nothing less than an attempt at a new national anthem; Neil Diamond meets de Touqueville. Coming on the heels of a presidential campaign where the issues are astoundingly trivialized by the media, this is the real stuff, the CNN of the soul: "It's coming through a hole in the air; from those nights in Tiananmen Square: From the wars against disorder, from the sirens night and day; from the fires of the homeless, from the ashes of the gay: Democracy is coming to the U.S.A."

Chelsea (Bradley) Manning

Chelsea (Bradley) Manning has been senteced to 35 years in prison for being a source to Wikileaks, a charge Manning plead guilty to and admitted. Manning was motivated by conscience---seeing war crimes being committed and after trying to get the Washington Post and other papers to report the story, Manning went to Wikileaks---publishing the Collateral Murder video, Iraq and Afghan war logs, and  State Department Diplomatic Cables.

The information helped start the Arab Spring, and showed the world the true story of the US government.  The information that the government kept secret from the American people hid the true cost of the wars, and Manning and Wikileaks showed the American people and the world the truth about what the government was doing in our name.  The release of the information caused no harm, and even the government admitted this during the 3 month trial---which  was also kept from the public!!! (except for a few DEDICATED journalists and the Freedom of the Press Foundation link here)

Economy---

I'm for regulated Capitalism

I really only want Government to do a few things----safety and labor laws and regulations---so enforce overtime, minimum wage, consumer protection, safety standards in products,

and banking regulations---especially role STOPPING recessions---that is when Government stimulus should kick in---when private credit freezes because of risks, that is when government should borrow money and lend it to the economy----lender and borrower as last resort


with the 2008 crisis over housing i would have done things differently---let banks fail, AIG was different though, that was an insurance company which froze credit markets for GE which had no problems---

NO FORECLOSURES on primary houses---allmortgages should be paid off at some time, but have help during a recession or crisis ---i would have done anything else----a one year moratorium, no payments---paid for by FED---allow partial payments as a statement of faith and will---""i would like to pay but cant afford whole payment now""

any stimulus would have gone directly to people---those who lost jobs, those who missed a few payments on mortgages (not more than a year etc, cant just not pay forever)---right now even Obama is restricting help to homeowners who haven't missed a payment, and banks make you miss 3 payments, they don't accept partial payments,

so here are just a few examples

I am aware that Jeremy Hammond has plead guilty to violations of the Computer Fraud and Abuse Act (CFAA). I am writing you ask for leniency in his sentencing. He has already spent more than enough time behind bars.

The sentences associated with the CFAA are vastly disproportionate to the crime. Jeremy faces up to 10 years in prison for politically motivated acts of civil disobedience, from which he sought no financial gain.  Meanwhile, those of Jeremy's co-defendants convicted in Ireland and the UK will not spend more than 16 months in prison. Some have already been released.

Jeremy sought only to make the world a better place. I respectfully ask for leniency in his sentencing.

We have the First Amendment rights to freedom of speech, press, assembly and petition the government in order to make sure Congress listens to the people they represent


Why we have government

We hold these truths to be self-evident, that all men are created equal, that they are endowed by their Creator with certain unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness.--That to secure these rights, Governments are instituted among Men, deriving their just powers from the consent of the governed.

The Constitution
We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defence, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.

The Constitution sets up a Congress of a House and Senate, Role of President and the Courts, sets guidelines for laws and prohibitions----there aren’t many actual laws in the Constitution, but mostly a guideline for Congress who is the Legislative branch that will be writing laws (you can do this but not this when writing laws, etc)

There is no single, universally accepted definition of terrorism. There are many reasons for this (not the least of which is the cliche “one man’s terrorist is another’s freedom fighter”). Even different agencies of the US government have different working definitions. Most definitions usually have common elements, though, oriented around terrorism as the systematic use of physical violence–actual or threatened–against non-combatants but with an audience broader than the immediate victims in mind, to create a general climate of fear in a target population, in order to effect some kind of political and/or social change.

Terrorism by nature is difficult to define. Acts of terrorism conjure emotional responses in the victims (those hurt by the violence and those affected by the fear) as well as in the practioners. Even the U.S. government cannot agree on one single definition. The old adage, “One man’s terrorist is another man’s freedom fighter” is still alive and well. Listed below are several definitions of terrorism. For the purposes of the Terrorism Research Center, we have adopted the definition used by the Federal Bureau of Investigation.

When the Justice Department admitted to gathering months of records from more than 20 Associated Press telephone lines, it startled average Americans and the established media alike. It was a dangerous overreach by the DOJ, whose powers are strictly limited under its own guidelines for issuing subpoenas to the news media for testimony and evidence.

Congress responded to this gross executive overreach by seeking to codify legal protections for journalists and their sources, but despite the best of intentions, they’re missing the mark in their attempt to create a tight definition of a “journalist.”

The Founding Fathers explicitly protected the press in the First Amendment because it is such a critical service to a free society, but they were smart enough not to define what “the press” was. Journalism is society’s greatest safeguard against government abuse, and Congress should seek to protect it in all its forms, and not define it to fit their own devices.

Denny Argall, the FBI'S public liaison officer, wrote that after the agency searched for responsive records it located one "cross reference" file pertaining to a pending criminal investigation. The FBI would not comment further about the nature of the probe.

One of the excerpts in the FBI document is completely redacted and marked "S" (for "secret") and "Per Army," under an exemption aimed at protecting national security. Additional redactions were used to protect techniques and procedures for law-enforcement investigations and prosecutions.

The documents revealed that on June 11, 2012, the FBI's Washington field office opened a file and submitted "unclassified media articles" to it in order "to memorialize controversial reporting by Rolling Stone magazine on June 7, 2012."

Jeff Light, a Washington, D.C.-based attorney who filed the FOIA lawsuit, suggested opening such files on reporters was not common. "It's interesting [that] the FBI memorializes controversial reporting," he said.

The FBI documents also stated that in addition to Hastings' report, the agency also submitted one copy of a "blog entry relative to the aforementioned articles" and "one copy of Emails Express Discontent," which is an article about Bergdahl published on June 7, 2012 by the Associated Press that was based on Hastings' Rolling Stone report.

The "blog entry," however, appeared to be lifted from the comments section of the Idaho Statesman newspaper. The comment was apparently written by Gary Farwell, the father of Matthew Farwell, who contributed reporting to the Rolling Stone story and is identified at the bottom of the story as "a former soldier who deployed to Afghanistan."

I [Wright] talk about two members of the Joint Terrorism Task Force who came to my office to ask about phone calls that I made to a number in London. It belonged to a solicitor who represented some of the jihadis I had been interviewing. During the course of the conversation, they asked who “Caroline Wright” was. That’s my daughter. She was a university student at the time, not living at home. None of our phones were registered in her name. The only way I could imagine that they got her name was by listening to my phone calls.
Before this episode, I had been told by a source at the Counter-Terrorism Center that my source had seen a summary of a telephone interview I had with Zawahiri’s cousin in Cairo. At the time, I figured that the Egyptians had covered the conversation and supplied it to the CIA. On December 16, 2005, when the New York Times revealed that the NSA was illegally wiretapping Americans, I thought otherwise.
I’m glad the JTTF came to my house to clear this matter up, but it’s an example of the danger of awarding government such extraordinary powers. A simple misunderstanding such as this could easily have led to having Caroline’s name placed on an FBI link chart, only two steps away from Al Qaeda.
One day, Al Qaeda will fade away, but we will still be left with the swollen security state that we’ve created to fight it. That’s another challenge we haven’t begun to face.

Since January 2011, I have covered the WikiLeaks release of US State Department Cables, JTF memoranda known as the 'GTMO files', and revolutions across Egypt, Bahrain, Iran, and Yemen, as well as the legal proceedings against Manning and the US investigation into WikiLeaks. I have interviewed a preeminent US foreign policy expert on the Cambodia cables, and published hours of interviews with former GTMO guards, detainees, defense lawyers, and human rights activists, as well as WikiLeaks media partners: Andy Worthington, a GTMO historian and author, and Atanas Tchobanov, the Balkanleaks' spokesman and co-editor of Bivol.bg.

Why do I do this work? Because it moves me deeply. Because I am compelled to learn and to understand. The positive results of some of my work also grants me a sense of common purpose in service to my fellow man/woman.

When the US Government said in Federal Court that they would not guarantee that I would not be indefinitely detained without charge under Section 1021 of the National Defense Authorization Act FY2012 for articles I had written on the 'War on Terror', you set aside partisanship. You realized that what is as stake is more than an election. What was at stake is the safety of your friend, your daughter, a fellow citizen or journalist, as well as this nation and people across the globe. The NDAA, after all, was passed with bi-partisan support, and signed into law by President Obama.

Court: These people have real things they are saying. These are not speculative or hypotheticals. These are people who have actually written articles that we have here. [The Court then held up the articles written by O'Brien and marked as Court Ex. 3.] We are trying to figure out, are these articles going to subject Ms. O'Brien to risk under § 1021? . . . .

Government: Again, I'm not authorized to make specific representations regarding specific people. I'm saying that 'associated forces' cannot extend to groups that are not armed groups at all.

Court: So we don't know about the articles, it depends?

"O'Brien has written a series of articles already--some of which relate to al-Qaeda, the Taliban, or "associated forces" no matter how defined. The Government was unwilling to state at the hearing that O'Brien would not be detained under § 1021 for her expressive conduct in regard to those articles. Moreover, O'Brien testified that she has withheld at least two articles from publication because of her concerns regarding the potential for her expressive conduct in those articles to render her a "covered person" under §1021 and thereby subject her to military detention."
Section 1021 of the NDAA FY2012 allows for the indefinite detention without charges or trial of anyone, including American citizens, who are deemed by the US Government to be terrorists or terrorist sympathizers. The institutions of civil society - the press and civic square - are now what our military terms an information environment in a global theater of war. The 'War on Terror', our military says, is fought with intelligence and information. And, the US Government has already detained journalists at Guantanamo Bay under the AUMF seeking to gain intelligence on media organizations. The President has already played a personal role in the imprisonment of a journalistcovering the US 'War on Terror' in Yemen.

Government contractors falsely linked a group, which I helped found - whose only purpose is to support campaign finance reform in the United States - to Al Qaeda.

I was sent messages by a Government contractor saying that I was now associated with Al Qaeda and so called 'cyber-terrorists'

Citizenship is a public office, but who among us can risk engaging in the body politic authentically, when we have families to provide for? Who can risk publishing about the workings of Government, our alliances, and wars when you might end up in my position?

No matter what your party affiliation, Section 1021 of the NDAA FY 2012 violates the First and Fifth Amendments to the US constitution, the principles that safeguard the independence of our republic and any real freedom or lasting security for our citizens and all peoples.






“For the first time in American history, we have a law authorizing the worldwide and indefinite military detention of people captured far from any battlefield. The NDAA has no temporal or geographic limitations. It is completely at odds with our values, violates the Constitution, and corrodes our Nation’s commitment to the rule of law.” – The ACLU

Section 1021 defines a “covered person” – one subject to detention – as “a person who was a part of or substantially supported al-Qaeda, the Taliban, or “associated forces” that are engaged in hostilities against the United States or its coalition partners, including any person who has committed a belligerent act or has directly supported such hostilities in aid of such enemy forces.”

The law, however, does not define the terms “substantially supported,” “directly supported” or “associated forces.” As it stands, the law violates the 1st, 4th, 5th, 6th and 8th Amendments of the US Constitution and most of the Bill of Rights.

DHS memos sent to law enforcement across the country stated organizers of US Day of Rage were likely high level cyber terrorists. The media followed suit, publishing those allegations and others, including the groups alleged association with Al Qaeda, jeopardizing Ms. O’Brien’s career, her standing in her community, and her liberty under the 2012 NDAA.



Daniel Ellsberg is a former United States military analyst who, while employed by the RAND Corporation, precipitated a national political controversy in 1971 when he released the Pentagon Papers, a top-secret Pentagon study of U.S. government decision-making in relation to the Vietnam War, to The New York Times and other newspapers. Mr. Ellsberg is publicly supporting PFC Bradley Manning, and has been subjected to arrest at protests. He is 81 years old. Mr. Ellsberg was awarded the Right Livelihood Award in 2006. He is one of the most highly lauded government whistle-blowers in US history.

Noam Chomsky is an American linguist, philosopher, cognitive scientist, historian, and activist. He us currently a Professor Emeritus in the Department of Linguistics & Philosophy at MIT, where he has taught for fifty years. Dr. Chomsky has gained a worldwide following as a political dissident for his analyses of the pernicious influence of economic elites on U.S. domestic politics and foreign policy. He claims double standards in a foreign policy preaching democracy and freedom for all while allying itself with non-democratic and repressive organizations. According to the Arts and Humanities Citation Index in 1992, Chomsky was cited as a source more often than any other living scholar from 1980 to 1992.

In January, the State Department reassigned the special envoy who had been in charge of trying to persuade countries to take Guantanamo inmates approved for release, Daniel Fried, and did not replace him. That was widely seen as a signal that Obama was giving up on closing the prison any time soon. 

Obama has blamed Congress for interfering with his plan to close Guantanamo. Starting in 2011, Congress began restricting transfers out, saying the Defense Department first had to certify a number of things, including that the destination country was not a state sponsor of terrorism and would take action to make sure the individual would not threaten the United States.

Starting last year, Congress let some restrictions be waived if it was in the "national security interests" of the United States. Obama has not used the waiver or certification provisions.

Two years ago, Obama signed an executive order establishing extra review procedures for Guantanamo detainees to determine if continued detention were warranted, but the Periodic Review Boards have not been used.

This option looks fairly simple, since it involves carrying out the president's own executive order. But there may have been no rush to establish more reviews boards since prisoners cleared by earlier review boards are still being held.

Wells Dixon, a senior attorney at the Center for Constitutional Rights, suggested the administration could use court rulings to help get prisoners released. Two members of China's Muslim Uighur minority were resettled in El Salvador in April 2012, four years after a U.S. District Court in Washington ruled there were no grounds to hold them.

When prisoners challenge their detention in federal court, the government could decide not to contest the case, paving the way for a court order effecting the prisoner's release, said Dixon. He said that could happen in any of the more than 100 detainee "habeus corpus" cases filed in federal court.

Obama could instruct the Justice Department to stop contesting those cases.

The impromptu comments were a little surprising for their rhetoric, sounding more like a 2007 campaign speech than the words of someone who has been U.S. president for four-plus years. As the New Yorker's Amy Davidson put it, "He spoke as if he had happened upon the place, like a bystander."

The poll asked both self-described Democrats and Republicans — including "leaners" — if they think their own parties are taking things in the right or wrong direction. Democrats approved of their party's direction, with 72% saying leadership was taking the party in the right direction to just 21% who said it was taking things in the wrong direction.

But Republicans largely disapprove of their own party's leadership, as has been the case for quite some time now. Just 37% of self-identified Republicans and Republican "leaners" say leadership is taking the party in the right direction. Meanwhile, 52% say it's taking things in the wrong direction.

That's a big change from last August, when Republicans approved of their leadership by a 58-32 margin.

William Woodward ""snuck up on a Labor Day barbecue and opened fire at about 12:30 a.m. on Sept. 3, 2012. Police arrived and found VICTIMS Gary Lee Hembree, Roger Picior and Bruce Timothy Blake all had been shot. Hembree and Picior died of their injuries. Blake, who was hit 11 times, survived.  The motion filed by Woodward’s attorneys says in the hours prior to the shooting, all three men were yelling at Woodward and that this type of behavior had been ongoing for over a month."" link

William Woodward is a veteran and is the 44-year-old brother of Titusville fire Chief Michael Woodward. link 

Stacie tells me his father is a retired Brevard County Sheriff, and his sister-in-law is the personal assistant to the chief of police.

Woodward had been the target of a variety of threats and “exercised his right under Florida law to defend himself and his family that night.” link

"We have a pattern of behavior of constant threats to Mr. Woodward and his family, some of them quite graphic, and including threats to sodomize and rape his 12-year-old daughter," said Woodward's lawyer, Greg Eisenmenger   link

Things escalated to gunfire just after midnight Monday -- Hembree's ex-wife says Woodward accused their daughter of stealing some items from his carport.  Police say they have responded to disputes between the suspect and victim several times, even offering a neutral site for discussion at the police department. The disputes even landed them in court, but no injuctions were given to either party. link

Stand Your Ground becomes Bush Doctrine (preemptive strike) 
It cited the "Bush Doctrine" to justify Woodward's response to the perceived threats, referring to George W. Bush's concept of waging pre-emptive war against potential threats before they metastasize into imminent threats.  “I think legally that term has sort of been evolving especially given changes of our government’s definition of ‘imminent,’” Robert Berry, one of the attorneys representing Woodward, told Florida Today. “It’s become more expansive than someone putting a gun right to your head. It’s things that could become, you know, an immediate threat.”   link

The stand your ground motion Woodward's attorneys filed in court says Woodward didn't have to wait for anyone to point a gun at him. In fact, the motion quotes United States policy in killing international terrorists, saying, in effect, if the U.S. can kill terrorists with drones, Woodward can shoot his plotting, threatening neighbors.
The motion will force a judge or jury to decide whether Woodward stood his ground.  link

The documents describe how investigators said Woodward went into full military mode while carrying out the attack.
According to documents, Woodward fired 31 rounds. WFTV learned there is surveillance video that shows Woodward crawling on his belly to the first neighbor's house. In the video, a victim can be heard calling Woodward a "plastic G.I. Joe" before he was shot.
Woodward told police after the shooting he considered himself on a "mission" and that he was in "a war zone," according to documents.  link

Sept 25th Stand Your Ground Hearing in Woodward Case link here
Woodward's Attorney argued in court today that a jury should decide whether his client's charges should be dismissed under Florida's Stand Your Ground law. Judge Morgan Reinman said she would decide on or before November 20, but Woodward's attorney anticipated that her decision would be appealed either way.

Woodward’s attorneys had filed a motion saying he had been the target of a variety of threats and “exercised his right under Florida law to defend himself and his family that night.”

Friends and family of Gary Hembree protested outside the Brevard County Courthouse, waving signs and calling for justice Wednesday.

The protests came before a hearing for William Woodward, who is seeking a "stand your ground" hearing.
"It's awful, it's awful... The family's not the same without Gary," Hembree's mother Dorothy Huppert said.

"It's beyond craziness now… I don't get it," Blake said.

Blake said he's angry Woodward's attorney is looking for a "stand your ground" hearing.

Woodward's attorney doesn't want a typical "stand your ground" hearing with the judge ruling. He wants a separate trial with jurors deciding if he should stand trial for the shootings.

question laws that senselessly expand the concept of self-defense and sow dangerous conflict in 
our neighborhoods. These laws try to fix something that was never broken. There has always 
been a legal defense for using deadly force if – and the “if” is important – no safe retreat is 
available.
But we must examine laws that take this further by eliminating the common sense and 
age-old requirement that people who feel threatened have a duty to retreat, outside their home, if 
they can do so safely. By allowing and perhaps encouraging violent situations to escalate in 
public, such laws undermine public safety. The list of resulting tragedies is long and –
unfortunately – has victimized too many who are innocent. It is our collective obligation – we
